A Registered Trademark Design protects the outline or shape of a design you have developed. To be registered your trademark logo or design must comply with a number of elements:

  1. The design of the trademark logo must be new. Therefore the design must not have already been developed or released on the marketplace anywhere in the world; and
  2. The design must be distinctive. A design is considered distinctive if it is not substantially similar to any other design.

Examination of the Design application must be requested in Australian in order to obtain sole rights to the Registered Design.

The registration of a Design in Australia can last a maximum of 10 years.
