International trademarks

MacMillan Trademarks have been protecting and managing the international trademark requirements for Australian multinational companies since 2007, and are the single point of contact for companies around the world registering their trademarks in other countries.

There are two ways we can seek international trademark protection, summarised below:

A single “international” trademark application

Often the most efficient method of applying for an international trademark is through a single Madrid trademark application. This form of application is possible through a protocol to the Madrid Agreement, an international trademark agreement covering over 80 countries. To be eligible for filing, the Madrid Protocol application must be based on a separate trademark in Australia filed beforehand.

Australia has been a member of the Madrid Protocol since July 2001 and some of the other members countries include (this is not a complete list):

  • United States of America
  • Philippines
  • Republic of Korea
  • India
  • European Union
  • New Zealand
  • United Kingdom
  • Mexico
  • China
  • Vietnam
  • Japan
  • Switzerland
  • Singapore
  • Zimbabwe

Individual trademark registration in other countries

International trademark protection can also be obtained by filing with individual countries, and may be necessary for trademark registration in those countries that are not members of the “Madrid Protocol”, such as Canada.

In this case, an application must be made to each country you are seeking a trademark.

We can also register a European Union trademark, which covers all countries of the European Union (currently 28 countries).

MacMillan Trademarks have associate attorneys in each country to make sure the trademark application is filed in accordance with the laws of that country and the application proceeds without delay.

In all countries an address for service is required as part of the application, which we provide without additional cost.
